Do insurance providers treat whiplash victims ... - AM Personal Injury

Do insurance providers treat whiplash victims fairly in the uk?

A whiplash injury is sustained if your neck is flexed forward and backward at a rapid unnatural movement usually because of an crash. The more intense the impact the more the chance that a whiplash type injury could be sustained.

It?s very common for road accident victims to be affected by neck pain and despite huge improvements in safety technology, the quantity of whiplash claims being made in the uk keeps rising.

If perhaps you were not responsible for a personal injury and also have suffered injury because of this, the law allows you to claim damages from the negligent party. Making a?whiplash claim isn?t really difficult however you may perhaps wish to consider carefully if you should use solicitors (lawyer) to aid you or whether in fact you ought to put your case personally to your negligent party.

]]>

Most insurance companies strongly encourage people to claim directly with them instead of seek counsel of any independent law firm. Their reasoning tends to be that whiplash claims are generally fairly simple to deal with, costs are normally lower and compensation payments very similar regardless of whether legal advice has actually been obtained. Lawyers on the contrary will argue that insurers usually aren?t in the routine of throwing money away on claims if they can keep costs down by reducing compensation awards for pain and suffering ? they are going to do exactly that. Does this mean the injured party gets short changed? Very possibly.

If a solicitor is used to conduct a personal injury claim in the uk and also the claim is successful, then legal costs are automatically paid from the negligent party?s insurance company. It is a basic requirement that forms a part of any agreed settlement. The injured party doesn?t have to be concerned about paying a hefty legal bill afterwards of any case. Most lawyers will make no deductions out of your monetary award for that reason 100% of your compensation is to be payable.

The issue of legal representation should come down to whether an injured individual feels safer and happier with the knowledge that their case has actually been conducted in their best interests ? other than for the benefits or convenience of some insurance company or legal professional.

When someone wants legal representation after a whiplash accident, then the option is there. If they would like to handle the matter personally then that is certainly also possible but potentially riskier but more time intensive over the long haul. The key point should be to make sure that people exercise their legal rights and settle a justified claim completely to their approval.

September is National Leukemia & Lymphoma Awareness Month ...

Three and a half years in and I never knew this. Or, maybe I did and I forgot. Who knows.

September and Leukemia & Lymphoma Awareness Month.

Did you know?

  • About 1,596,670 new cancer cases are expected to be diagnosed in 2011.
  • In 2011, about 571,950 Americans are expected to die of cancer, more than 1,500 people a day. Cancer is the second most com?mon cause of death in the US, exceeded only by heart disease. In the US, cancer accounts for nearly 1 of every 4 deaths.

Since my main diagnosis is chronic lymphocytic leukemia (secondary is small lymhocytic lymphoma), let?s talk a little about it.

  • An estimated 44,600 new cases of leukemia are expected in 2011.
  • An estimated 21,780 deaths are expected to occur in 2011.
  • Leukemia, a cancer of the bone marrow and blood, is classified into four groups according to cell type: acute lymphocytic (ALL), chronic lymphocytic (CLL), acute myeloid (AML), and chronic myeloid (CML).
  • Survival rates vary substantially by leukemia type, ranging from a 5? year relative survival of 24% for patients diag?nosed with AML to 80% for those with CLL.

People always tell me they don?t know what to say or don?t know what to do, here are a few suggestions.

  • If you area not already, consider becoming a bone marrow donor. Joining the registry is not hard and you could possibly save someones life (maybe me someday:).
  • Or, turn Facebook/Twitter orange to help raise awareness. Snag the graphic below and set it as your profile picture for the month of September.

*I claim no credit for either of these graphics, they were both snagged from Google images.*

Republican presidential candidate former Rep. Newt Gingrich gets a laugh as he takes part in the American Principles Project Palmetto Freedom Forum Monday Sept. 5, 2011, in Columbia, S.C. (AP Photo/ Mary Ann Chastain)

(AP) ? Pledging fidelity to the Constitution and vowing to carry the tea party's priorities to the White House, the Republicans chasing the GOP's presidential nomination pitched themselves Monday to their party's libertarian activists as the strongest candidates to roll back four years of President Barack Obama's tenure.

Former Massachusetts Gov. Mitt Romney said the Obama administration flouted the Constitution to push a political agenda. Rep. Michele Bachmann of Minnesota stridently called Obama's policies "unconstitutional" at the same tea party-backed forum on Labor Day. And Texas Gov. Rick Perry, the third member of his party's top tier, told a separate town hall-style audience earlier in the day that he has a better record on jobs than the president.

With Labor Day marking the unofficial start to the 2012 campaign, the contenders were painting themselves to the tea party during an afternoon forum with Sen. Jim DeMint in his home state ? site of the first nominating contest in the South. The event was designed to probe the candidates on their views of spending, taxes and the Constitution ? bedrock principles for the tea party activists whose rising clout is likely to shape the nominating process.

"I don't think I've ever seen an administration who has gone further afield from the Constitution ... than the Obama administration, not just with regulation, but with energy policy, with financial regulatory policy and, with the worst example, Obamacare," Romney said, outlining conservatives' broad indictment of Obama's tenure.

It also was a prime opportunity for the candidates to level pointed ? though, in many cases, familiar ? criticism of Obama.

"The track record we have creating jobs, I'd put up against anyone running for president of the United States, particularly the current resident of the White House," said Perry, whose late entry into the race threatens Romney's one-time aura of inevitability with support from tea partyers.

And Bachmann sought to sustain her status as a movement darling and suitable alternative to Romney. Although she never engaged him directly, her remarks seemed centered on Romney.

Bachmann warned that Obama and Democrats' health care legislation was taking away freedoms and giving Washington abject power.

"They will become a dictator over our lives," she said of federal requirements included in the overhaul that requires Americans to have health insurance. Massachusetts requires a similar mandate.

"This is the foundation for socialized medicine. Make no mistake about it. It will change the face of this nation forever," she warned.

After keeping the tea party at arm's length most of this campaign, Romney appeared at two tea party-related events this holiday weekend, first in New Hampshire on Sunday and then Monday here. He slightly tweaked his pitch and acknowledged critics of Massachusetts' health plan.

"Our bill dealt with 8 percent of our population, the people who weren't insured," Romney said.

"He dealt with 100 percent of American people. He said, 'I'm going to change health care for all of you.' It's simply unconstitutional. It's bad law. It's bad medicine. ... It has got to be stopped and I know it better than most."

Aware of the tea party's potential to pick the nominee, all candidates have tailored their pitches to appeal to the libertarian and grassroots activists.

Bachmann, a former federal tax lawyer, called the Constitution "that sacred document" and challenged Obama's understanding of his powers under it. She cited Obama's advisers, whom she called "czars," the Justice Department's decision not to appeal a court's overturning of a federal marriage law, and his immigration policies.

"These are areas where we see unconstitutionality," she said of Obama, a Harvard Law School graduate and former constitutional law lecturer at the University of Chicago.

Former House Speaker Newt Gingrich played up the founding fathers' writings on liberties during his appearance: "These rights are inalienable. That means no politician, no bureaucrat, no judge can take that away from you."

Rep. Ron Paul of Texas, a favorite of the GOP's libertarian wing, decried government largesse: "People were supposed to carry guns, not bureaucrats." He also warned against a Washington that gives the Federal Reserve too much power, a favorite rallying cry for his steadfast supporters.

And pizza magnate Herman Cain of Georgia, who does well during these forums with amusing quips but hasn't built a serious campaign organization, again was critical of Washington.

"The idea in Washington, D.C. ... is if you reduce the growth, that's a cut," he said. "That's not a cut. That's deceiving the American people."

Ahead of the forum, Perry spoke at a town hall-style meeting before heading home to Texas in a last-minute schedule change to monitor raging wildfires. He phoned DeMint to apologize for his schedule change; DeMint said Perry needed to be home.

Romney, who had initially planned to bypass the South Carolina forum, changed his schedule last week to join DeMint, whose backing he enjoyed during his first presidential bid.

While DeMint is tremendously popular here in his home state and with his party's tea party faction, he isn't rushing to publicly pick a favorite this time and has suggested he might not back a candidate in the primary.

That's not to say wooing the tea party is without peril.

After Washington's debt showdown this summer, an Associated Press-GfK poll found that 46 percent of adults had an unfavorable view of the tea party, compared with 36 percent just after last November's election.

Thoughts From Teens: Personal Finance Discussion | Everyday Tips ...

Today marks the first post from my new blogging category: ?Thoughts From Teens. ? Posts will be written by one of my kids, or a teen we know. ?The goal of this category is to share life from a teen?s point of view, which you might find is quite different from your own. ?I am also hoping that through comments, the teens both writing these posts and reading the posts can learn some things from all you knowledgeable readers too.

The post today was written by my 17 year old son Nathan, who is starting his senior year of high school today. ?The topic was inspired by fellow blogger MoneyCone, who was curious what a 17 ?year old thinks about finance in general.

Disclaimer: this is my first experience writing something of this nature. ?If you don?t mind, I would really appreciate if you tell me what you think in the comments section. ?Also, if there are any other topics you are curious about from a teenager?s perspective, please comment on that too. ?Thank you for reading?Nathan

Personal finance is something of a daunting mystery to me right now. ?Although I took a class on PF in 10th grade (class being a very loosely used term, our teacher was more interested in educating us on her board game collection than on actual finance), and took a two week crash course on it as part of the health curriculum, I still feel rather in the dark about ways to effectively manage money when I?m forced to become self-sufficient. ?This isn?t to say my parents haven?t educated me on personal finance, they have, but there are still many questions I find myself asking such as:

What in the world should I invest in?

I ask myself this question because of many exterior influences: the floundering stock market, a conversation I had with a former Merill Lynch higher-up about investing in commodities, radio commercials touting the price of gold in a volatile economy etc. ?However,?Cracked.com assures me that investing in mutual funds has always been, and will remain, the safest way to invest your money, but it leaves me with other questions- mainly ?what is a Mutual Fund??. ?Easily answerable questions aside, it?s still intimidating to look at the Finance page of the newspaper and see all of the companies and their corresponding values.? Choosing which companies to invest in seems like a guessing game to me. ?In the days of downgraded credit ratings and mass bailouts, investing in any formerly financially stable company seems impossible. ?Investing in other things, such as commodities or foreign currency, is even more foreign to me than stocks. ?These investment decisions will continue to bother me until I figure out a way to master them, if I ever do.

What amenities should I have?

Perhaps amenities is a misleading word because what I am referring to is things like Internet access, phone service, cable TV, etc., but let me digress? Since I currently plan on getting a teaching degree, I?ve begun to realize that living the same life that my parents have given me is going to be next to impossible. ?As a result, I?ve started to think about the things I will or won?t need in the future. ?My thoughts have led me to believe that maybe entertainment devices- DVD player, multiple game systems, maybe even the TV, won?t be necessary to have around in the future. ?Online streaming capabilities have rendered our DVD player all but unnecessary and the expansion of such capabilities, not to mention an increase in Netflix prices, have led me to believe a movie reader won?t be needed in the future. ?And don?t get me started on home phones. ?Landlines are just ?money vacuums now that nearly everybody has a cell phone. (Unless, of course, you enjoy being solicited by telemarketers; then a home phone is vitally important.) ?At this point though, it is hard to know what ?amenities? I will want or need in the future.

Should I get a credit card?

In the aftermath of ?The Great Recession?, I?ve heard many stories about families going so far as cutting their credit cards into pieces and using paper money exclusively to keep expenses controlled. ?Since I started hearing these stories, I too have thought about avoiding credit cards. ?These thoughts were quickly ignored though by the overwhelming consensus that you must have a credit card in today?s environment. ?Everything from applying for loans to buying a car or house is partially influenced by your credit score. ?Not having a credit card is a red flag as far as I can tell. ?My mom has discussed with me how to remain out of debt even if you do have a credit card, but it involves actually paying your bills off each month. It is amazing how many people don?t do this, ?and I feel confident that I know enough to avoid debt. ?Knowing is half the battle, and since I know how to avoid falling into debt, I see my future finances as rather stable as long as my purchases don?t get too impulsive (no promises there).

Overall, I feel rather positive about my financial future. ?The only thing that I truly worry about besides what I mentioned above ?is student loans. ?These loans will certainly saddle me when I first leave college but my parents, who were no stranger to loans, have also equipped me with ways to pay off debt without it having too profound an effect on my day-to-day life. ?(Note from Kris: ?This does not mean we plan on paying off his student loans, we have equipped him with knowledge, not an endless supply of cash.) ?Although I tend to be a cynic, I treat my financial security with optimism and will probably continue to until I actually have to support myself. ?Having parents as adept as mine at keeping their finances in order has certainly helped, and them telling me their strategies has certainly helped also. I recommend that all parents do the same for their kids, as we really are listening, at least most of the time.

Rapper T.I. back in federal prison after luxury bus ride (Reuters)

ATLANTA (Reuters) ? A ride in a luxury bus from Arkansas to a halfway house in Atlanta has landed Grammy Award-winning rapper T.I. back behind bars just two days after his release from federal prison.

The Atlanta entertainer, whose real name is Clifford Harris, was scheduled to spend the last month of his sentence in a residential transition facility, prison officials said earlier in the week.

Prisons spokesman Chris Burke confirmed on Friday that T.I. had instead been incarcerated in a federal prison in Atlanta but said he did not know the reason why.

The rapper's release date from prison is September 29, Burke said.

According to Steve Sadow, T.I.'s attorney, prison officials had an "issue" with the bus the entertainer used to travel from Arkansas to Atlanta.

"We are awaiting the opportunity to quickly resolve whatever the issue may be that the Federal Bureau of Prisons has with T.I.'s method of transportation -- bus -- from Arkansas to Atlanta, so that T.I. can return to the halfway house to complete the remaining days of his sentence," Sadow said in an email to Reuters.

The entertainer was sentenced in October 2010 to 11 months in prison for violating the terms of his probation on federal gun charges after he was arrested on suspicion of possessing the drug ecstasy.

It was his second stint behind bars in three years.

T.I.'s career began as a rapper in 2001 but he then branched out into other areas of the music and film industry, finding success both as a producer and actor.

On Wednesday, cable channel VH1 said it had teamed up with the 30-year-old "Got Your Back" singer for a 10-episode series that will follow his readjustment to life outside prison and the making of a new album. The series is due to premiere on December 5.

Pennsylvania Certified Elder Law Attorney Quoted in TIME ...

(PRWEB) November 26, 2004

Pennsylvania Elder Law Attorney Jeffrey Marshall is quoted in the November 29, 2004 issue of Time Magazine, available now online at http://www.time.com. Marshall, an expert in elder law and estate planning, was interviewed by Time columnist Francine Russo for the Generations column. The column deals with problems arising between children when a parent becomes incapacitated and one child holds power of attorney and withholds information from other involved family.

The column advises that the child without power of attorney is not helpless. It quotes Attorney Marshall as noting that family members have a number of protections and remedies: they can seek an accounting from the power of attorney, file for guardianship, or call protective services if they suspect financial abuse.
